President Obama Support Marriage Equality
President Obama, who has long said his views on same-sex marriage were “evolving,” today affirmed his support for marriage equality. In an interview with ABC’s Robin Roberts, the President said “I’ve just concluded that for me personally it is important for me to go ahead and affirm that I think same sex couples should be able to get married.”
Obama’s support comes after a week in which Vice President Biden said he was “absolutely comfortable” with marriage equality and in which North Carolina voters approved a ban on same-sex marriage in their state’s constitution.
The President’s evolution on the issue has taken several years, from “undecided” to “supports civil unions” to, now, full equality.
Mitt Romney refused to comment directly on the President’s statement, but Romney did say this to the Denver Fox affiliate before the President’s statement:
“Well when these issues were raised in my state of Massachusetts, I indicated my view, which is I do not favor marriage between people of the same gender, and I do not favor civil unions if they are identical to marriage other than by name. My view is the domestic partnership benefits, hospital visitation rights, and the like are appropriate but that the others are not.”
In other words, Romney doesn’t just oppose marriage equality, he also opposed civil unions and just about anything beyond “hospital visitation rights.”
Other reactions:
From New York City Mayor Michael Bloomberg: “No American president has ever supported a major expansion of civil rights that has not ultimately been adopted by the American people – and I have no doubt that this will be no exception.”
HRC’s incoming president, Chad Griffin: “President Obama’s words today will be celebrated by generations to come. For the millions of young gay and lesbian Americans across this nation, President Obama’s words provide genuine hope that they will be the first generation to grow up with the freedom to fully pursue the American dream. Marriage-the promise of love, companionship, and family-is basic to the pursuit of that dream. Our Constitution’s promise, the promise of liberty, is one that every generation must realize. As President Obama recognized today, the fight to secure marriage equality is the defining element of our generation’s search for greater freedom.”
Anti-marriage zealot Gary Bauer: ”President Obama’s endorsement of same-sex marriage surprised no one. The charade is finally up. We’ve always known that Barack Obama supports same-sex marriage. With every action he’s taken, from court appointments to his rhetoric, he’s been preparing the way to undermine traditional marriage. Obama’s finally made that support explicit…It’s a political move meant to energize his leftwing base and distract Americans from his disastrous economic policies.”

I’ve stood on the side of broader equality for the LGBT community. I hestitated on gay marriage in part because I thought civil unions would be sufficient. I was sensitive to the fact that for a lot of people, the word ‘marriage’ evokes very powerful traditions, religious beliefs.
I have to tell you that over the course of several years as I have talked to friends and family and neighbors when I think about members of my own staff who are in incredibly committed monogamous relationships, same-sex relationships, who are raising kids together, when I think about those soldiers or airmen or marines or sailors who are out there fighting on my behalf and yet feel constrained, even now that Don’t Ask Don’t Tell is gone, because they are not able to commit themselves in a marriage, at a certain point I’ve just concluded that for me personally it is important for me to go ahead and affirm that I think same sex couples should be able to get married.
It’s interesting, some of this is also generational. You know when I go to college campuses, sometimes I talk to college Republicans who think that I have terrible policies on the economy, on foreign policy, but are very clear that when it comes to same sex equality or, you know, sexual orientation that they believe in equality. They are much more comfortable with it. You know, Malia and Sasha, they have friends whose parents are same-sex couples. There have been times where Michelle and I have been sitting around the dinner table and we’re talking about their friends and their parents and Malia and Sasha, it wouldn’t dawn on them that somehow their friends’ parents would be treated differently. It doesn’t make sense to them and frankly, that’s the kind of thing that prompts a change in perspective.
This is something that, you know, we’ve [the President and Mrs. Obama] talked about over the years and she, you know, she feels the same way, she feels the same way that I do. And that is that, in the end the values that I care most deeply about and she cares most deeply about is how we treat other people and, you know, I, you know, we are both practicing Christians and obviously this position may be considered to put us at odds with the views of others but, you know, when we think about our faith, the thing at root that we think about is, not only Christ sacrificing himself on our behalf, but it’s also the Golden Rule, you know, treat others the way you would want to be treated. And I think that’s what we try to impart to our kids and that’s what motivates me as president and I figure the most consistent I can be in being true to those precepts, the better I’ll be as a as a dad and a husband and hopefully the better I’ll be as president.
“I’ll Marry You” — Italian Gay Wedding Video
This Valentine’s Day video, called “I’ll Marry You,” is named after the song by Lorenzo “Jovanotti” Cherubini. Produced by Italy’s Arcigay Brescia and Agedo (Italy’s PFLAG), the video “tells the story of a couple of young guys who decide to marry, in the town, while another pair, formed by two girls, promises to do the same.”
Washington State Legalizes Same-Sex Marriage
Washington State Governor Chris Gregoire signed legislation that legalizes same-sex marriage today. The New Civil Rights Movement recaps the history of this momentous moment:
Gregoire made national headlines early last month when she announced she had made a strong personal journey and now supported same-sex civil marriage, launching her push to offer marriage to all Washington citizens. One month later, the bill has become law. Washington is now the seventh state and eighth jurisdiction, including the District of Columbia, to offer civil marriage to all citizens. It is also the first state to repeal its Defense of marriage act which prohibited same-sex couples the right to marry.
The law takes effect on June 7th. It was shepherded by openly-gay state representative Jamie Pederson, who plans on wedding his “future husband” Eric:
Rep. Jamie Pedersen (D), who sponsored and ushered the bill, along with Senator Ed Murray, spoke eloquently time after time, opened today’s proceedings, and paid tribute to Gregoire’s journey and previous support for other LGBT protections.
Pedersen introduced and thanked his “future husband,” Eric, with whom he has four children. “I’m deeply grateful for his love and support.”
Gregoire gave an impassioned speech at the signing, saying that marriage equality was “the civil rights fight of [her daughter's] generation.” You can see here speech here:
Anti-marriage zealots have promised to take the issue to the ballot box, as they did in California. It’s possible that the 9th Circuit’s ruling on Prop 8 would apply here. The court ruled that once a right was granted, it could not be taken away without a substantial, rational reason. Prop 8 passwd because of anti-gay bigotry, the court said, and so therefore was invalid. The same thing could happen in Washington state. Marriage News Watch looks more at this issue.

Right Wing Blames “Hollywood” For Prop 8 Ruling
It’s all Hollywood’s fault. Unable to admit that Prop 8 was nothing more than simple bigotry, and angry that the 9th Circuit called them on it, the right wing has decided it’s a Hollywood conspiracy. As is typical in this type of attack, the Alliance Defense Fund also made certain to throw some vitrol towards Hollywood’s northern sybling, San Francisco. Here’s the full quote from the Alliance Defense Fund:
“We are not surprised that this Hollywood-orchestrated attack on marriage–tried in San Francisco–turned out this way. But we are confident that the expressed will of the American people in favor of marriage will be upheld at the Supreme Court. Every pro-marriage American should be pleased that this case can finally go to the U.S. Supreme Court. The ProtectMarriage.com legal team’s arguments align with every other federal appellate and Supreme Court decision on marriage in American history.”

Romney Claims He Saved Massachusetts from Becoming a “Gay Las Vegas”
Speaking at CPAC, Mitt Romney sought to play up his conservative, anti-gay credentials by saying he prevented Massachusetts, which legalized same-sex marriage while he was governor, from becoming “the Las Vegas of gay marriage.”
Think Progress says that Romney “bragged about” using an obscure 1913 law, which was originally intended to limit inter-racial marriage, to keep out-of-state same-sex couples from tying-the-knot in Massachusetts:
ROMNEY: I fought to have a stay on that decision, then pushed for a marriage amendment to our Constitution. We lost by only one vote in the legislature. And I successfully prohibited out- of-state couples from coming to our state to get married and then going home. On my watch, we fought hard and prevented Massachusetts from becoming the Las Vegas of gay marriage.
When I am president, I will defend the Defense of Marriage Act, and I will fight for an amendment to our Constitution that defines marriage as a relationship between a man and a woman.

Prop 8 Ruling: What the Dissenting Judge Said
Judge N. Randy Smith dissented in today’s ruling by the 9th Circuit Court of Appeals that Prop 8 is unconstitutional. While I may not agree with his reasoning, it’s worth examining because I suspect it will come up over and over as the case (and similar ones) wind their way through the legal system.
Smith’s argument boiled down to a few things:
1. Smith thought a ban on same-sex marriage “rationally related to furthering the interests of promoting responsible procreation and optimal parenting.”
2. Smith cited minority opinions from past rulings in favor of LGBT rights (i.e., the loosing site) and old court rulings that have subsequently been overturned. Essential he argued there was legal precedent for banning same-sex marriage while ignoring that the “legal precedent” no longer has (or never had) the force of law.

White House Won’t Comment On Prop 8 Ruling
As one would probably expect in an election year in a country as polarized as this one, the White House has no comment on the ruling that Prop 8 was unconstitutional. White House Press Secretary Jay Carney has this to say:
I don’t have a comment on litigation in general and in this litigation to which we are not a party. Beyond that, I can say that the President has long opposed, as you know, divisive and discriminatory efforts to deny rights and benefits to same-sex couples.
Not much of a comment.

Narrow Ruling Overturns Prop 8 in California But Doesn’t Address Constitutional Right to Same-Sex Marriage
The 9th Circuit Court of Appeals decision to overturn Proposition 8 is momentous and people are overjoyed, but it’s worth nothing that the decision was made on narrow grounds. They overturned Prop 8 in California, but didn’t establish a constitutional right to same-sex marriage in the United States.
According to the court, this is what the ruling did:
The panel majority affirmed the judgment of the district court and held that Proposition 8, which amended the California Constitution to eliminate the
previously guaranteed right of same-sex couples to marry, violated the Fourteenth Amendment of the United States Constitution. The panel majority held that by using their initiative power to target a minority group and withdraw a right that it possessed, without a legitimate reason for doing so, the People of California violated the Equal Protection Clause.
In plain English, what they’re saying that that it was unconstitutional to “withdraw” a right (marriage) a minority group (LGBT people) has without a good reason. Basically, they’re saying that once you have a right, you have it barring some compelling reason for a change.
